BETHEL PARK SCHOOL DISTRICT RESOLUTION #86-2020

In response to Bethel Park School District Resolution No. 86-2020 (passed on January 28, 2020 and included later in this posting), the Allegheny County Law Department has approved the following question for placement upon the April 28, 2020 General Primary ballot:

 

BETHEL PARK SCHOOL DISTRICT

ACT 1 REFERENDUM QUESTION 

Shall the Bethel Park School District be permitted to exceed the maximum real estate millage rate permissible under Pennsylvania Act 1, currently 21.65 mils, to a rate of 22.8763 mils, for the 2020-2021 school fiscal year.  This proposed rate restores the 2018-2019 school fiscal year real estate millage rate?

Pennsylvania Election Code (25 P.S. 2621.1) requires this Division to prepare a “plain English” explanation for any question appearing on the ballot. To this end, the ballot explanations for the referenda are as follows:

      Should this Act 1 referendum question receive a majority of “yes” votes, the Bethel Park School District shall be permitted to set real estate millage, for the 2020-2021 school fiscal year, at 22.8763 mils.  

      Under Pennsylvania Act 1, the maximum real estate millage permissible, without a voter referendum, is currently 21.65 mils.

      Therefore, for the Bethel Park School District real estate tax millage to increase, this question must be approved by a majority of voters.   

 

The following is the resolution that was passed by the Bethel Park Board of School Directors at its January 28, 2020 Regular Meeting.

BETHEL PARK SCHOOL DISTRICT RESOLUTION 86-2020

WHEREAS, the Board of School Directors of Bethel Park School District desires to restore the

2018-2019 real estate tax millage rate by levying a real estate tax millage rate of 22.8763 for the 2020-2021

school fiscal year, which exceeds the District’s permissible millage as defined by Act 1 of 2006, including

the addition of the Act 1 Index and any approved referendum exceptions; and

 

WHEREAS, such millage rate may only be imposed under Act 1 through submission of the matter

to the District’s electors through a ballot referendum approved in the April, 2020 primary election; and

 

WHEREAS, the Board desires to restore the District’s millage rate to 22.8763 real estate mills,

which was the millage rate in place during the 2018-2019 school year, and which exceeds the maximum

rate permissible under Act 1 of 2006, which is 21.65 mills including the increase permitted under the Act

1 Index; and

 

WHEREAS, the Board desires to submit to a ballot referendum for the April, 2020 primary the

following question: “Whether the School District may restore the 2018-2019 real estate tax millage rate by

levying real estate taxes at the rate of 22.8763 mills for the 2020-2021 school fiscal year, a rate which

exceeds the maximum millage rate permissible under Act 1, which is 21.65 mills including the Act 1 Index

adjustment?”

 

NOW THEREFORE BE IT RESOLVED, that the Bethel Park School Board hereby authorizes

a ballot referendum to be submitted to the appropriate Allegheny County Department of Elections officials

for the purpose of being placed on and considered at the April 28, 2020 primary election to seek approval

to levy real estate taxes at the rate of 22.8763 mills for the 2020-2021 school fiscal year.

 

BE IT FURTHER RESOLVED, the appropriate officers of the District are authorized to take all

action necessary to carry out this Resolution, including consultation and collaboration with the Department

of Elections in the creation of a plain language explanation of the proposed Referendum.

 

RESOLVED, at a public meeting held this 28th day of January, 2020.
